Getting an EIN

An EIN is the business equivalent of a tax file number. The IRS issues it free of charge.

When you need one

  • You have more than one member
  • You will hire employees or run payroll
  • You will elect corporate or S corporation tax treatment
  • Your bank requires it, which is almost always the case

How to apply

If the responsible party has a Social Security Number or ITIN, the IRS online application usually issues the number immediately during IRS operating hours. Otherwise, submit Form SS-4 by fax or mail, which takes longer.

The responsible party must be a natural person who controls or manages the entity, not another company.

The IRS never charges for an EIN. Any fee you pay is for someone preparing and submitting the application on your behalf.

After you receive it

Store the EIN confirmation letter safely. Replacing it is slow, and banks and payment processors ask for it.

Can a non-resident get an EIN?

Yes. No SSN or ITIN is required, but the application must go by fax or mail rather than online.

Do I need a new EIN if I change state?

Usually not for a simple move, but structural changes such as converting to a corporation can require a new one.
