Louisiana lesson 4 of 6

Get an EIN and register with Louisiana Revenue and Workforce agencies

The EIN identifies your LLC to the IRS and to banks. Louisiana also expects most active LLCs to register with the Department of Revenue, and any LLC with employees to register with Louisiana Workforce Commission.

Applying for the EIN

Apply for free directly on the IRS website once your Articles of Organization are approved. If the responsible party has a US social security number or ITIN, the EIN is issued immediately online; otherwise the application goes in on Form SS-4 by fax or post.

Registering with Louisiana Department of Revenue

Register through the Department of Revenue for a state sales tax account if you sell taxable goods or services, and for withholding tax if you have employees. geauxBIZ can route this registration alongside your formation filing, or you can register separately through the Department of Revenue directly.

An LLC that elects C corporation tax treatment for federal purposes also files Louisiana corporation income tax returns; the state's franchise tax on LLCs has been repealed, so a standard pass-through LLC does not owe it, but confirm current treatment for a C-Corp election on the Department of Revenue's site since corporate tax rules are set separately from the franchise tax repeal.

Registering as an employer

If you hire employees in Louisiana, register with Louisiana Workforce Commission for state unemployment insurance in addition to your Department of Revenue withholding registration. Both are separate from the EIN and from the Secretary of State filing.

Key takeaways

  • The EIN is free and comes from the IRS.
  • Register with the Department of Revenue for sales tax or withholding once either applies to your LLC.
  • Employers also register separately with Louisiana Workforce Commission for unemployment insurance.
