Montana lesson 4 of 6

Get an EIN and register with Montana Revenue

Your EIN identifies the LLC to the IRS and to your bank. Because Montana has no general sales tax, most LLCs have a shorter list of state tax registrations than in sales-tax states, but withholding and other registrations still apply once you have employees or certain kinds of income.

Applying for the EIN

Apply for free directly on the IRS website once your Articles of Organization are approved. If the responsible party has a US social security number or ITIN, the number is issued immediately online; otherwise the application is filed on Form SS-4 by fax or post.

Registering with Montana Department of Revenue

Since Montana has no general sales tax, most LLCs do not register for a sales tax permit. If you hire employees, you still need to register with the Department of Revenue for state withholding tax. Certain industries, including lodging and rental vehicles, owe Montana's specific accommodations or rental vehicle taxes even though there is no general sales tax, so check the Department of Revenue's guidance if either applies to your business.

Opening the account

Bring your confirmed Articles of Organization, EIN confirmation letter, an operating agreement if you have adopted one, and identification for signers and significant owners. Route all business income and expenses through this account, since mixing personal and business funds undermines the liability protection an LLC is meant to provide.

Key takeaways

  • The EIN is free and issued by the IRS.
  • Most Montana LLCs skip sales tax registration, but employer withholding registration still applies with staff.
  • Lodging and rental vehicle taxes can apply even though Montana has no general sales tax.
