Appoint your South Dakota registered agent
Every South Dakota LLC must continuously maintain a registered agent with a physical in-state address, under the state's version of the Model Registered Agents Act.
Who can serve
South Dakota allows three routes: a commercial registered agent listed with the Secretary of State, a named noncommercial individual or business entity with an actual South Dakota street or rural route address, or an internal office or position within the LLC whose holder is designated to receive service of process. A post office box alone does not satisfy the registered office requirement for a named noncommercial agent.
What the agent does
The registered agent receives service of process, official notices from the Secretary of State, and correspondence tied to the LLC's compliance status, including annual report reminders. Because South Dakota's Secretary of State can serve process on the state itself as an alternative when an agent cannot be located, keeping the registered agent information accurate protects the LLC's ability to respond to a lawsuit in time.

Changing the agent
File a statement of change of registered agent or registered office with the Secretary of State whenever the appointment changes, rather than waiting for the next annual report to update it.
